Summer solstace:
Radio ad for one week before concert was voted for. We have 4 sponsors at $300 so far from Raymond. 10 doz. t-shirts were ordered for regular T's. 4 doz. tanks. Sponsor package was sold with 1 doz. free T's for each business. Band is up to 14 performers. Sound and lights are on. Policeman for on site - Don took care of. Generally everything is coming together. Need to announce for volunteers for beer, t-shirt booth.
New Business:
Annie brings up bad language used by performers. Summer is more family time. John has reminded performers at set-up to be more aware of kids.
Frank was discussed. John says he called and wants to return. A motion was made that Frank cannot return to Mallory to perform. It passed.
Johnathon complaint from Joann was discussed. The motion was made for a 30 day probation period due to 3 complaints against him. Tabled sexual harassment complaint until it's discussed with attorney. This was done 6/8/00. Included is the opinion from attorney Al Kelly. A "hostile workplace" policy is being written to be hung at kiosk and included in our guidelines.
The decision to just stay with the 30 day probation with no further suspensions was made by board members Cydall, Isaac, Rick, Annie and Annette.

Ron Hernandez was removed from board as a result of park incident. Monice Greer is new board member being the first on waiting list. Motion passes.
Barb Winko read her complaint against Ron Hernandez on park incident. Letter is put into our minutes. Joanne Hassman received 30 day probation for park incident. Because of nature of the complaint the board did not think suspension was necessary (for striking Ron). Suspension for striking Johnathon on pier was not enforced since the pier manager had not been called during the incident that night.
Old Business:
General meeting date is set for July 19th 2000, Bayview Park at noon.
Bags to sell for C.P.S. with logo. Rick found a good deal at 15 cents a printed bag. Set-up cost between $150-$200. Art work from our business cards will be used. O.J. has art work already. Stamps will be made for smaller bags.

Meeting with Al Kelly 6/8/00
1. Proxy votes: So far all agenda and ballot notices have been correct and in keeping with Roberts Rules. Next step, Mr. Kelly requests the original signed articles from the state in copy form. Then he writes the "Notice of By-law change" according to Florida law.
This "Notice of Change" is sent or given to members no sooner than 4 weeks and no later than 1 week before our July 19th general membership meeting. This will notify our membership of the vote.
It is placed on the aganda which is posted 4 weeks in advance of meeting. The vote must carry a majority to pass.

2. Joann Harrassment Complaint:
Mr. Kelly called an attorney that conferrd with him on this issue. Sunset Celebration is not an employer. We do not have an employer id number. But we do provide a "workplace" for self-employed artists and food vendors. Mr. Kelly's opinion was that the statement made by Johnathon was not sexual in nature but did in fact create a hostile environment by being an "offensive remark".
Sexual harassment is usually defined as touching, explicit photos, or cartoons hung in the workplace. Also, using sex as means of better standing in the workplace; ie. higher pay or higher position.
Sincer there was no other complaint filed with reference to this remark by the tourists or other vendors, it became he said/she said. In our guidlines we have steps that are to be used in dealing with problems. Starting with calling the pier manager. This was not followed in this case.
Under these circumstances Mr. Kelly felt the board was fair to give the 30 day probation to both parties. Mr. Kelly pointed out that in fact, the law reads that "any unwanted touching or striking" is considered battery.
Joann was not suspended as is written in our rules, for any period of time, she was placed on probation.
To conclude this issue for C.P.S., Mr. Kelly is writing a "policy" which will be hung at Kiosk for our pier managers and members to follow. This will allow C.P.S to help have a "non-hostile workplace".
Need two letters to be made. One to Johnathon and one to Joann.

The board has voted on a 30 day probation period for the park incident. Concerning the nature of your complaint we feel a 3 day member against member suspension is not warrented at this time. The striking of Johnathon on the pier has no action since the pier manager was not summoned as procedure calls for.
Enclosed is the opinion from attorney Al Kelly. Because of your complaint, C.P.S is taking steps to make a policy that provides members with a "non-hostile workplace". Under this policy we will have steps available to us as a board. As it reads now, there are no rules or guidelines for us to follow.
Your probation period is 6/7/00 - 7/7/00.

The board has voted on a 30 day probation period for having 3 complaints filed against you. It will run from 6/7/00 - 7/7/00. We hope you understand that you work with the general public and will act accordingly.
We are having a policy written for a "non-hostile work place". Your remark was offensive and created a hostile environment for Joann who was set up next to you. Please read this policy and try to follow the suggestions.
