Board Meeting 08 06 08

The meeting was called to order at 10:12 by Chairman Beau Dobbs

Roll call: Beau, Joyce, Don, Harriet, Ryan.

Jeep complained that Dominique is to prominently featured on the site. We decided to look into the site too see how he is being featured.

Items were added to the agenda. The complaint, talking to the lawyer, painting the kiosk.

Andy reported that he marketing committee will meet this afternoon.

Susan Schaal has quit the board, Solaya Mireault is the first alternate board member. She asks for the board meetings to be moved to the evening so that she can make only one trip to down town for both the board meeting and work.

Joyce made a motion that the board meetings be moved to around 2:30 hrs before vendors lottery. Ryan seconded passed.

PC report: given by hector. Lorenzo Alvarez (America's boy friend) wants to sell a product that is identical to Americas. There is a rule against exact replication. This will be discussed later. Elaine was discussed the PC has asked for a written complaint to act on. The new digital rules were presented. There are 5 rules. Will S. objects to the lack of water available on the pier. He wants to have water sold on the pier. Maybe cps can hand out water. We will look into this.

Joyce made a motion to approve the PC report, Ryan seconded passed.

The pier managers report was presented by Andy. Dale has been suspended for being drunk. Andy would like the pier manager to have an ID card or something. We could do a laminated card to clip on.

Joyce made a motion to accept the pier managers report. Ryan seconded, passed.

Performers report, there was a meeting, Will talked about forming a performers guild. Mathew was discussed, but He wasn't grandfathered. The performers are sick of dale being drunk. They want dale permanently suspended. There were stories about dales drunken history. Some solutions were suggested but most had already been tried. Some people on the board wanted to have him suspend a few more times. Before he is permanently suspended. We can go to the lawyer and ask him if we can suspend him. If he says yes, then we can suspend him. Joyce will talk to a lawyer this week. Jeep recommended that we suspend dale until next meeting. The other performers agreed. The board is not suspending him at this time.

Joyce made a motion that we accept the performers committee report Ryan seconded, passed.

Oj gave a financial report. We have earned 2,768 this month.

There was some discussion about the audit. Michelle Kirby has been performing an audit. OJ has given her a large amount of documents and has asked OJ to verify old records. Yesterday she has spent 3 hours on reviewing how we do business. Who signs off on things, policies etc... She will be calling the secretary maybe and the treasurer and she suggested a second person signing off on money besides the pier manager. She double checked that we are paying the right amount to the city. The cost will come in some where around 2,500. Joyce made a motion to accept the financial report don seconded.

Secretaries Report, Ryan presented the minutes from 7-23-08 Joyce made a motion to accept the secretaries report don seconded passed

Ryan make a motion that Joyce will approach the lawyer to consult on Ray and Dale and she will have a budget of up to $500 Joyce seconded passed.

There was a complaint from America against Sandy. That sandy was harshly critical about Americas use of the alley. And that she had made derogatory and racist comments about America. It is reported that sandy has written a letter of apology, things seem to have calmed down. We need to send a letter that says that it is not appropriate for her to regulate the alley and any comments of the racist type would be inappropriate Joyce made a motion that we send a letter to sandy and not take action, don seconded, passed.

Jeep objects to Dominique being on the site so prominently. OJ will take Dominique off the "now appearing" section of sunsetcelebration.org.

It was suggested that at the next incident, we could ask the cop to give Dale a citation for being publicly drunk. We can also trespass him.

Ryan makes a motion that if Lorenzo's buoys and coconuts are different from americas than they are fine, if they are the same than they are not fine. Joyce seconded,

The PC has been using a policy that if two products are different in three ways than this is enough differences. to say that they aren't exact duplicates.

The motion passed.

Joyce moved that we accept he digital committee recommendations, Ryan seconded. Passed.

The water was discussed. Can the food people Sell water? Can the city fix the water fountain? Can the food vendors sell water? This goes against the hand crafted policy. There is no policy against giving water away for free. No prepackaged drinks are allowed by the guidelines.

Solaya will get a pier manager badge holder from office max.

On Wednesday 7:30 we will paint the kiosk free setup fee set up for anyone who comes and also free breakfast.
